CALIFORNIA CALL TO ACTION: Contact Your Legislators to Oppose AB 1755
The California legislature is considering AB 1755, a bill that could drastically overhaul the lemon law and weaken consumer protections. The lemon law applies to new cars under warranty that have defects affecting their use, value, or safety, where multiple repair attempts have been made. Toyota is aligned with over one dozen other automakers and multiple consumer advocacy groups that are sour on this bill.
If passed, this legislation could have negative impacts on both customers and our business by:
- Imposing a new statute of repose, cutting off the time a customer can bring a lawsuit on a defective vehicle, even if there is a longer warranty duration
- Shortening, from four years to one year, the statute of limitations for lawsuits after the warranty expires
- Adding a requirement for customers to provide detailed written notice of a lemon law demand in certain situations
- Permitting customers to sell their vehicle after a lawsuit is filed. This would not allow automakers to inspect the vehicle for quality or to defend the case, and potentially puts some cars with quality issues back on the road
